We have not been in a position to update for over a week due to no communication and information being given to the contractor. The latest news we have this morning is that we probably won’t hear anything for another few days. That there will be much less people needed than was originally forecast and that BP have around 3000 people working on it and these numbers are made up with a large proportion of volunteers…hence the need for less workers when we do get the go ahead. Please join the mailing list by filling out the form below and we will update as and when we get more information. The list will be deleted when this comes to a conclusion so you wont get any unrelated emails from me after we get some resolution to this situation for oil spill jobs.

Latest Information on the Oil Spill Clean Up Jobs

The Latest information that we have from the contractor is to stop taking applications for the time being. They have had hundreds of applications directly, as well as hundreds through Osrec, and things are on hold as there is uncertainty where the Oil Spill will end up.

Without definite information and instructions from the Prime contractors, the sub contractors are in the same situation with not being able to update applicants.

I have been told to keep watching the news to get the latest developments of the spill and we should have more information on Thursday or Friday at some point.

This is a really frustrating situation as we cannot inform everyone with any certainty of what is going on. We also cannot contact everyone individually by email and respond to every individual request for information due to the sheer volume of applications. If you have not already done so please sign up on the form at the bottom of the page and get the latest updates by email at the same time as everyone else.

1. US Citizenship through Naturalization

You may be eligible to obtain U.S. citizenship if:

•   You are a foreign national with 5 years permanent residence in the U.S. and at least half that time you were physically present inside the U.S. with no periods of absence over six months.

•   You are a permanent resident for 3 years, who is currently married to a U.S. citizen, and has been married to the same U.S. citizen for the past 3 years.

•   You have served the U.S. Armed Forces for at least three years

•   You performed active duty military service in the U.S. Armed Forces during:

World War I (November 11, 1916 – April 6, 1917)

World War II (September 1, 1939 – December 31, 1946)

Korea (June 25, 1950 – July 1, 1955)

Vietnam (February 28, 1961 – October 15, 1978) or

Persian Gulf (August 2, 1990 – April 11, 1991)

•   You were married to a U.S. citizen who died during a period of honorable active duty service in the U.S. Armed Forces

•   You served on a vessel operated by the U.S. and have been a U.S. permanent resident for the past five years

•   You are an employee or an individual under contract to the U.S. Government and have been a U.S. permanent resident for the past five years

•   Are a person who performs ministerial or priestly functions for a religious denomination or an interdenominational organization with a valid presence in the U.S., and have been a U.S. permanent resident for the past five years

•  You are a spouse of a U.S. citizen who is one of the following:

A member of the U.S. Armed Forces

An employee or an individual under contract to the U.S. Government

An employee of an American institution of research recognized by the Attorney General

An employee of a public international organization of which the United States is a member by law or treaty

An employee of an American-owned firm or corporation engaged in the development of foreign trade and commerce for the United States

A person who performs ministerial or priestly functions for a religious denomination or an interdenominational organization with a valid presence in the United States

2.  US Citizenship through Birth

•  Any child born in the U.S. automatically acquires U.S. citizenship, even if the child’s mother was in the U.S. illegally. This provision does not apply to a child whose parent was a foreign diplomat at the time of birth.

3.  US Citizenship through Parents

Even though a child is born outside the U.S., the child automatically acquires U.S. citizenship if at least one parent was a U.S. citizen at the time of the child’s birth

•    If both parents were U.S. citizens at the time of a child’s birth outside the U.S., and at least one parent had a prior residence in the U.S., the child automatically acquires U.S. citizenship.

•   If only one parent was a U.S. citizen at the time of a child’s birth outside the U.S., and that parent had previously resided in the U.S. for at least five years, with at least two of those years being after the age of 14, the child automatically acquires U.S. citizenship.

4.  US Citizenship through Adoption

•   Children under 18 years of age holding green cards may be naturalized if petitioned for by a U.S. citizen parent.

5.  Reclaim Lost Citizenship

•   Individuals born before 1934 in foreign countries to U.S. citizen mothers, and were denied citizenship because of retention requirements and the law of the day

•   Former U.S. citizens who prior to September 22, 1922 lost U.S. citizenship because of marriage to a foreign national who was ineligible for naturalization

•   Former citizens losing citizenship for failure to meet physical presence retention requirement according to law prior to 1978

•   Former citizens losing citizenship by entering armed forces of foreign countries during World War II

•   Children who lost their U.S. citizenship through failure to meet the retention requirements of the law

TN Visa Overview

NAFTA is the North American Free Trade Agreement. It creates special economic and trade relationships for the United States, Canada and Mexico. The nonimmigrant NAFTA Professional (TN) visa allows citizens of Canada and Mexico, as NAFTA professionals to work in the United States. Permanent residents, including Canadian permanent residents, are not able to apply to work as a NAFTA professional.

Time Limit: There is a 5 year limit on R-1 status, unless if the employment is seasonal for no more than a 6 month duration per year. After the 5 year limit is met, the R-1 worker would have to leave for 1 year before readmission. Another limitation is that dependents in the US are able to obtain work authorization.

TN Visa Eligibility

Professionals of Canada or Mexico may work in the U.S. under the following conditions:
• Applicant is a citizen of Canada or Mexico;
• Profession is on the NAFTA list;
• Position in the U.S. requires a NAFTA professional;
• Mexican or Canadian applicant is to work in a prearranged full-time or part-time job, for a U.S. employer (see documentation required). Self employment is not permitted;
• Professional Canadian or Mexican citizen has the qualifications of the profession
Requirements for Canadian Citizens
Canadian citizens usually do not need a visa as a NAFTA Professional, although a visa can be issued to qualified TN visa applicants upon request. However, a Canadian residing in another country with a non-Canadian spouse and children would need a visa to enable the spouse and children to be able to apply for a visa to accompany or join the NAFTA Professional, as a TD visa holder. To apply for visa, please see the requirements under the section Mexican Citizens – Applying for a TN Visa – Required Documentation.
A Canadian citizen without a TN visa can apply at a U.S. port of entry with all of the following:
• Request for admission under TN status to Department of Homeland Security, Customs and Border Protection, U.S. immigration officer;
• Employment Letter – Evidence of professional employment. See Employment Letter below;
• Proof of professional qualifications, such as transcripts of grades, licenses, certificates, degrees, and/or records of previous employment;
• Proof of ability to meet applicable license requirements;
• Proof of Canadian citizenship- Canadian citizens may present a passport, as visas are not required, or they may provide secondary evidence, such as a birth certificate. However, Canadian citizens traveling to the United States from outside the Western Hemisphere are required to present a valid passport at the port-of-entry;
• Fee of U.S. $50
Requirements for Mexican Citizens

As of January 1, 2004 the procedures were simplified for Mexicans by removing the requirement for petition approval and for filing of a labor condition application. Mexicans are no longer subject to numerical limitation for these professionals. Mexican citizens still require a visa to request admission to the United States.

TN Visa Notes/Exclusions

About the NAFTA Professional Job Series List
For a complete list of professions with minimum education requirements and alternative credentials, see appendix 1603.D.1 on NAFTA’s webpage. With some exceptions, each profession requires a baccalaureate degree as an entry-level requirement. If a baccalaureate is required, experience cannot be substituted for that degree. In some professions, alternative criteria to a bachelor’s degree is listed. For some professions, experience is required in addition to the degree.

TN Visa Family Members

Spouses and children (unmarried children under the age of 21) who are accompanying or following to join NAFTA Professionals (TN visa holders) may receive a derivative TD visa. Applicants must demonstrate a bona fide spousal or parent-child relationship to the principal TN visa holder. Dependents do not have to be citizens of Mexico or Canada. Spouses and children cannot work while in the U.S. They are permitted to study.
Canadian citizen spouses and children do not need visas, but they must have the following documents at the port of entry:
• Proof of Canadian citizenship;
• Proof of relationship to the principal applicant, such as marriage certificate and birth certificate; and
• Photocopies of entry documents of the principal applicant.
Mexican citizen spouses and children must apply for TD nonimmigrant visas at a U.S. embassy or consulate.
If the spouse and children are not Canadian citizens, they must get a TD nonimmigrant visa from a U.S. embassy or consulate. They must contact the U.S. embassy or consulate that serves their area for information on how to make visa applications.

Spouses or children following to join must show a valid I-94, thereby providing proof that the principal TN visa holder is maintaining his/her TN visa status.

Who Pays The Fee?:
This is dependent on the visa type. In some cases the employer will pay and in some cases, and if it’s a non sponsored visa the applicant would pay. Some employers may request that you pay your own consulate fees and travel to the country, while others may not. It usually depends on the skill level, the type of position and the type of visa. For some visa types it maybe the law of the country that applicants should not pay any fees.

R1 Visa Overview

Immigration and Nationality Act (INA) 101(a)(15)(R) provides a nonimmigrant visa category “R” for individuals seeking to enter the United States to work in a religious capacity on a temporary basis.

Time Limit: There is a 5 year limit on R-1 status, unless if the employment is seasonal for no more than a 6 month duration per year. After the 5 year limit is met, the R-1 worker would have to leave for 1 year before readmission. Another limitation is that dependents in the US are able to obtain work authorization.

R1 Visa Eligibility

Religious workers include individuals authorized by a recognized employing entity to conduct religious worship and to perform other duties usually performed by authorized members of the clergy of that religion, and workers engaging in a religious vocation or occupation.
• The applicant must be a member of a religious denomination having a bona fide nonprofit religious organization in the U.S.;
• The religious denomination and its affiliate, if applicable, are exempt from taxation, or the religious denomination qualifies for tax- exempt status; and
• The applicant has been a member of the denomination for two years immediately preceding application for religious worker status.

• There is no requirement that individuals applying for “R” visas have a residence abroad that they have no intention of abandoning. However, they must intend to depart the United States at the end of their lawful status, absent specific indications or evidence to the contrary.
• The applicant has resided and been physically present outside the United States for the immediate prior year if he or she has previously spent five years in this classification.

Q2 Visa Overview

Named after Congressman James Walsh, the Irish Peace Process Cultural and Training Program Act established the Q2 visa classification, which allows up to 4,000 residents (between the ages of 18 ¬ 35) of Northern Ireland, and the Louch, Monaghan, Cavan, Leitrum, Sligo, and Donegal counties of the Republic of Ireland to be sponsored for up to 36 months in the United States in training and employment programs.

Q1 Visa Overview

It’s a nonimmigrant visa for a person who wishes to work temporarily in the United States.
